Three More Villagers in Svay Rieng Face Arrest

After Svay Rieng Provincial Court decided to detain two villagers, Mrs. Meas Srey, 38 and Mr. Prum Chea, 48 on December 23, 2009 over the accusation of purposely destroying Cambodia-Vietnam border demarcation, three more villagers are now facing arrest over the matter.

Sam Rainsy Commune Councilors Provisionally Arrested and Villagers Detained

In relation to the 6 poles uprooting in Samrong commune, Chantrea district and Porng Tek commune, Romdual district, Svay Rieng province, two Sam Rainsy commune councilors were transitionally arrested and five villagers were sued and arrested for state public property.

Visit to Cam-Viet Borders Blocked

On December 14, 2009 about 20 Sam Rainsy Party lawmakers, accompanied by some 100 local villagers from Chantrea and Romdual district paid their visit at the Cambodian-Vietnamese border, but they were banned and blocked on the street by police and authorities there.

Minor Crimes Police Officer Assaulted a Man

A violence case took place at about 7:45 pm on December 13, 2009 by a Minor Crimes Deputy Police Chief Neang Sokna on a victim, Phat Dara, 25. The victim is single, working as a mechanic. The event happened behind Buddha Khosachar, called Dam Dek Pagoda, in Srah Chork, Daun Penh district, Phnom Penh. The perpetrator used his short gun, Revolver to hit him on the face, head and ears, causing the victim bleeding. The victim has four brothers, living in poor condition, in No 28, St 216, Khmuagn commune, Sen Sok district, but nowadays he lives in Heng Heng Garage, No 12, St 39, Srah Chork commune, Daun Penh district, Phnom Penh.

Villager Representative Arrested over Land in Koh Kong

In relation to a chronic land conflict for years in Chroy commune, Sre Ambil district, Koh Kong, which cannot be solved, about 50 families were traveling by pickup to protest in front of Hun Sen’s mansion in Takmao town, Kandal province; but they were intercepted by 10 military police officers. One of the villagers was captured and brought back to Koh Kong.

Border Demarcations Encroached Villagers’ Land

Relevant to the border demarcation by both countries’ committees- Cambodian and Vietnamese, Cambodian people, who live along the border, are worried that their rice field will be encroached into Vietnam due to the new border demarcation; for instance the house of Mr. Heng Samrin, the president of the National Assembly in Prey Veng is also considered to have built in Vietnamese territory; and it became the subject to be confiscated recently.

Last Forced Eviction of Reak Reay Community

On December 4, 2009 nine remained houses in former Reak Reay community in Tonle Bassac commune, Chamkarmorn district, Phnom Penh were totally dismantled and destroyed by Phnom Penh Municipal authority to grant that land to Bassac Garden City Co and Canadiana Bank for high building development project.

Impact of Sand Dredging on Villagers in Koh Kong

More than 100 villagers from Dang Tung commune, Khemarak Phumin district gathered on Monday, November 30, 2009 to protest in front of provincial hall to seek the intervention of stopping the companies’ operations of dredging sand from the sea there. Local villagers asserted that the companies – Ly Yongphat Co and Udam Seima – had affected their livelihoods.

Land Grabbing of Ethnic Group in Ratanakiri

Solution has not been solved yet in relation to the land conflict in Bu Sra commune, Pech Chenda district, Mondulkiri province between a joint company Khoau Chuly and French Company Sofina and local villagers, who have had effect from the development project.

NGO Staffs Assaulted and Intimidated in Kampong Speu

Four staffs of a conservative forest organization, named Natural Resource Watch and Protection in Cambodia, were assaulted, intimidated to knee and say sorry on November 22, 2009 at 10:50 am in an area of Koh Koang village, Tang Samrong commune, Phnom Sruach district, Kampnog Speu province, while they all were trying to ask them for information and taking some photos.

Forced Eviction and Rights Violation in Kampong Thom

A serious violence burst out in November 16, 2009 in Ror Gnieng garrison, Kraya commune, Santuk district, Kampong Thom province, between joint forces, police, military police and anti-riot police and over 100 local villagers over land, which was grabbed by a Vietnamese company, called Tan Bien.

Six People Summoned over their Land

Five local villagers, who were asserted to be the victims of land grabbing from So Nguon Company, are facing legal action through the provincial court, accusing them of inciting people from other villages to protest against the company.

Villagers Meeting Banned and Intimidated

A meeting between local villagers and a community based organization, called Community for Peace Network (CPN), in a village was troubled and stopped by police and local authorities on Sunday, October 18, 2009. The meeting was held in Pleak village, Chikreng commune, Chikreng district, Seam Reap province, in order to seek solution for 11 local villagers, who were arrested regarding the violence over land in March 22 of the year.

Police Broke Up Protest in Kampot

About fifty fishermen living in Kep Thmei village, Kampot province came to protest on the street to stop the trucks from transporting land to fill up the shallow coast, which is believed to cause lots of problems to their livelihood, on Wednesday, October 28, 2009 by Keo Chea Property Development Company. However their protest was broken off by local authority and police.

Sam Rainsy’s Parliamentarian Immunity Lifted

Mr. Sam Rainsy, the president of Sam Rainsy Party faced the second time of legislative removal so that the court could take legal action against him for his statement, held on October 25, 2009 during the Buddhist ceremony [Bon Kakthen Tean] to Ang Rum Degn Pagoda in Samrong commune, Chantrea district near Cambodian-Vietnamese border; where he was also alleged to have uprooted six demarcation posts place by Vietnamese authorities.

Criminal Law Restricts Freedom of Expression

Worries and criticism exists politicians, rights defenders, both national and international NGOs about new Penal Code, which was finally ended on Monday, October 12, 2009; especially articles about freedom of expression, which becomes the target of incitement lawsuit, resulted in imprisonment from six months to two years as well as the fine from one to four million Riels.

Villagers in Reusey Keo Face Forced Eviction

At least around 20 houses of people living in Bie and Deum Kor village, Chroy Changva commune, Reusey Keo district, Phnom Penh, along National Road 6A were totally dismantled and destroyed by a group of 50 police and military police led by Reusey Keo Deputy Governor Koub Slesh and using bulldozer on October 15, 2009 in order to make way for an enlarged road and traffic roundabout linking the bridge from Choy Changva peninsula to Phnom Penh, whereas those houses’ owners were standing only to watch their houses and belongings demolished. Even though those local villagers asked the authorities to bring out some of their materials and belongings for daily utilization, it was not also allowed.

Vietnamese Illegal Fishing in Cambodian Water Ignored

In relation to the Vietnamese illegal fishing in Cambodia’s water border, local fishermen moved from their areas to the provincial office in Kampot in order to find out intervention from the authorities, but the problem has not been solved yet. On October 20, 2009 around 100 local residents came to protest in front of the provincial office to demand the authorities to take immediate action against the illegal fishing by Vietnamese people in Cambodian water territory, which resulted in the reduction of their daily income and the distinction of species of fish and other creatures in the sea.

Demonstration Law Restricts on Freedom of Assembly and Expression

New Law on Demonstration was successfully passed on October 21, 2009 by 76 out of 101 members of parliament, who participated in the meeting.

Mr. Yim Sovann, a lawmaker from Sam Rainsy Party, said that those 76 parliamentarians were from CPP, FUNCENPEC and Norodom Ranarith party; whereas his party [and Human Rights Party] did not vote for the law because it is likely to violate freedom of expression.

ECCC Judge Threatened of Legal Action

In relation to the case 002 of Extraordinary Chambers in the Courts of Cambodia [ECCC], including 4 former Khmer Rouge leaders, Khiev Samphorn, Nuon Chea, Ieng Sary and Ieng Thirith as well as there was requirement of 6 senior government officials to appear as witnesses at the hybrid court, for that reason, Co-Investigating Judge Marcel Lemonde faced legal lawsuits against him from lawyers of the accused.

Evictees Sent to Siem Reap Court for Questioning in Angkor Sugar Case

On November 30, 2009 Siem Reap Provincial Court summoned a villager in O’ Bat Moan, Kaun Kriel commune, Samrong district, Oddar Meachey for the accusation of allegedly logging forests in development area of Ly Yongphat Co, where 129 houses were burned and destroyed; and 214 families of the residents were violently evicted.

Villagers’ Life after the Eviction of Angkor Sugar

On October 14, 2009 some 50 families in O’Bat Moan were donated by Licadho with food, materials and others.

Mr. Chheng Sophors, Senior Human Rights Monitor for Licadho said the organization supported the victims, including 400 kilograms of un-milled rice, 40 tents, can fishes and noodles. In addition, the organization also provided them with a lawyer to defend this case.

Forced Evictions for Angkor Sugar (Ly Yongphat)

On October 9, 2009 joint workforce of police, military police and RCAF soldiers in Oddar Meanchey dismantled and burned 129 houses of 214 local families in O’ Bat Moan village, Kaun Kriel commune, Samrong city without warrants from court. This occurred since October 5, 2009. The villagers were accused of illegally living on the land, which belongs to Angkor Sugar company of a senator Ly Yongphat, and used as agricultural concession for development in 2007.

Land Evictees Accused of Incitement in Kampong Chhnang

In relation to land dispute about 108 hectares in Lorpeang village, Taches commune, Kampong Tralach district of Kampong Chhnang province, between KDC International, which belongs to Mrs. Chea Keng, wife of Mr. Suy Sem, the Minister of the Ministry of Industry Mines and Energy and 64 local families, up to now many of the villagers have been arrested and accused of incitement; and some of them migrated to Thailand to escape from being captured even though in August 8, 2008 there was directive from Prime Minister Hun Sen, KDC company appropriately resolved the problem for villagers in Lorpeang and Beoung Kak village.

Sam Rainsy Party Commune Councilor Arrested

On October 7, 2009 at about 10:00 AM a commune councilor from Sam Rainsy Party, Mr. Ly Srey Monin, 36, was arrested in handcraft after he left from a monthly commune council meeting. At that time, there were many joint taskforces including police officers and RCAF, but only three of them came up and escorted him from the steps of the office building. He was allegedly accused of involving with insulting, arson, committing violence and inciting during court execution on July 23-24, 2009. He was captured according to the order, which issued on July 2 by provincial court Sem Kuch.

A March Plan by Rong Chhun Prevented

On October 5, 2009 was the World Teacher’s Day. More than 100 teachers from 17 provinces in Cambodia gathered together in Phnom Penh to celebrate the ceremony and request the government for increasing teacher’s salary up to 1million riels per month, but the assembly was not allowed as planed in front of former Assembly Office building.

Villagers Got Physically Assaulted in Oddor Meanchey

On Thursday of October 1, 2009 joint 9 armed forces, policemen, military police and RCAF solders assaulted a mother and a son unconscious in Anlung Veng district, Oddor Meanchey province because of valuable timbers. The victims were a 44-year-old woman, named Mol Sina and her 24-year-old son, named Chhoeun Chanorn, sent to Anlung Veng hospital for emergency treatment. They left the hospital on September 6 after they felt much better.

Sam Rainsy Party Activist Shot Dead

Sam Rainsy Party activist living in Kor village, Chamnar Lew commune, Staung district, Kampong Thom Mr. Touch Hort, 46, was shot dead on September 4, 2009 by 2 unidentified men around 7:30 PM as he was having dinner with the family.

People in Dankor Protested at Hun Sen’s Manson over Land Grabbing

One hundred ten people from Prey Chisak village, Chom Chao commune, Dangkor district, Phnom Penh rallied in front of Hun Sen’s house on September 2, 2009 to seek intervention from the premier due to a new airport expansion project, which is going to impact 104 families living along the airport fence.

Sam Rainsy Party Activist Alleged of Private Property Destruction

A member of SPR provincial council Mr. La Peng living in Veunsai village, Veunsai commune, Veunsia district, Ratanakiri province was allegedly sued by a villager Lem Chhun nearby after he lifted up SRP label. Mr. La Peng was summoned by the provincial court to clarify the case on July 20, 2009.

Acid Victim’s Family Appealed for Justice Ignored

After the final verdict of Phnom Penh Municipal Court on August 31, 2009 by three judges- Den Sivutha, Sen Visal and Sem Sakola decided to drop charges against Mrs. Chea Ratha, 44, the former high-ranking military police officer and her 6 other associates in a brutal acid attack thanks to not enough evidence. However, the victim’s family still continued to appeal against the verdict.

Acid Attacker to Be At Large

Phnom Penh Municipal Court on August 31, 2009 dropped its charge on Mrs. Chea Ratha, former military police chief and her 6 subordinates for the acid attack on In Solida’s aunt, Ms. Ya Soknim, 39 years old, on May 26, 2008. The hearing was under the presents of 3 judges- Den Sivutha, Sen Visal and Sem Sakola dropped the case due to the lack of evidence to charge Chea Ratha and the 6 men.

Air Shot to Break out Demonstration in Kampong Speu

Samroang Torng district police, Kampong Speu shot into the air on May 21, 2009 in order to suppress some 1,000 garment workers as they had been doing demonstration for 4 days in Sang Wu Factory. The demonstration was to ask the factory owner to respect for Cambodia Labor Law; however, the boss of the factory did not show up to solve this problem at all.

Former Victims Sued for Defamation in Land Conflict

Four local villagers living in Chi Kreng district, Siem Reap province that were shot and seriously assaulted by police on March 22, 2009, were sued for defamation and summoned to be present at Siem Reap provincial court on August 25, 2009.

On July 21, 2009 Phnom Penh Municipality issued a statement to ask Phnom Penh Municipal Police and RCAF to search for those stayed behind the demonstration over 8 story building of Kandal Market’s new project.

Chea Mony Might Face Disinformation and Incitement

On August 21, 2009 the government planned to sue Chea Mony, the president of the Free Trade Union stressed the government could be involved in planning of the murder of his elder brother six years ago. Mr. Chea Vichea, his brother, was killed on January 22, 2003 on Paster road near Lanka Pagoda and near the news stall.

Miss Landmine Banned of Beauty Pageant

On August 2, 2009 the Cambodian government decided to stop the project of Miss Landmine Cambodia 2009 beauty pageant. This also banned some 20 participants from traveling to join in the ceremony for the reason of protecting the dignity of the amputees.

Market Traders Blocked of Access to Premier House

At least around 50 traders from Tunloip market in Takeo traveled to protest in front of Prime Minister Hun Sen’s house on August 14, 2009 in Takmao district, Kandal province to seek his intervention over market issue.

Local NGO Activist Intimidated in Ratanakiri

On March 29, 2009 a local right activist, named Khum Samrith, 37, living in Kok commune, Veunsai district, Ratanakiri was intimidated by the first deputy commune councilor, Huy Bouty, regarding his previous activities, which he thought affected the interest the councilor.

Local Activists Alleged of Illegal Detention

Two Sam Rainsy Party local activists in Chrey village, Kampong Svay commune, Kampong Svay district, Kampong Thom province were arrested for the accuse of illegally blocking an 18-year-old girl. A man named Ruan Chan aged 47 years old and his wife named Yang Eng also 47, both accused and arrested of blocking the girl, named Yen Chamreun, living next door.

Hun Sen Warned International Critics on Freedom of Expression

On August 12, 2009 Prime Minister Hun Sen warned European Union (EU) over critics about ‘Freedom of Expression’. This warning took place during his participation as the presidency of the graduate ceremony at the Royal University of Law and Economics after EU has shown its concerns over freedom of expression in Cambodia; especially complaints against some SRP lawmakers, the media and NGOs activists about defamation, disinformation and incitement.

Two NGO Activists in Kampong Speu Received Death Threat

Two NGO officers working on watching and protecting illegal forest logging in Cambodia were threatened around midnight of August 1, 2009 by some 20 soldiers pointing guns at him and prohibited to take any pictures of a truck carrying 10 cubic meter from National Park at Oa Ral mountain in Kampong Speu province, where the government has kept as conservation and protection area signed by King Norodom Sihanouk since 1993. However, local people living in the area reported that there is a lot of illegal logging by the rich and powerful men; and the people did not dare to do anything because they were armed forces to transport the timbers.

Prime Minister Warned Opposition of Autocracy

On Wednesday 5 August, 2009 Cambodian Prime Minister Hun Sen harshly reacted to some opposition members, who had criticized his present administration as autocracy or dictatorship. Stated at Build Bright University during his presidency participation in a graduation ceremony, Hun Sen warned that those critics might face legal action if they repeatedly called the country a “dictatorial regime”. “Be careful with the language of dictatorship. Be careful, one day legal action will be used,” he added by saying that, “Don’t tease me like that everyday. I listened to the radio; even though I do not talk about them, they still continue to criticize me.” “When I speak out against them they say that I am pressuring their freedom I say that they have thick faces, even if we chop them a hundred times with a cleaver they won’t be hurt.”

Clash between Police and Mu Sochua’s Supporters During March

Violence took place on the morning of Tuesday 4 August, 2009 at around 9:20 AM, near Langkar Pagoda and Independence Monument on Sihanouk street after authorities, including Municipal police, Interior police, criminal police, military police and police from Tourism department in different uniforms around 200-300 were subsequently trying to suppress a march held by Sam Rainsy Party.

Rights Activists in Ratanakiri Accused of Incitement

A well-known activist, Pen Bunna, 47, ADHOC coordinator and his colleague Chay Thy, 43, both ADHOC local activists in Ratanakiri were accused of being involved with incitement to cause violence between 121 families with the DM Group Ltd., over land conflict over 200 hectares.

Ex-workers of NAGA World Not Allowed to Hold Press Conference

A planned press conference to hold on July 31, 2009 by 14 former NAGA workers was not allowed by Phnom Penh authorities as the second time. The conference was to hold in front of NAGA World, the first largest casino in Cambodia for the reason that the 14 people, also union group leaders, known as negotiating group for common interest of all laborers, were able to express their opinions over the work condition, demand that they be allowed to start their job again.

Right Defenders, Journalist and Villagers Arrested

At least 28 people were arrested on July 24, 2009, after the verdict announced to order local villagers of 6 families in Kbal Spean village, Poipet commune, Poipet city of Banteay Meanchey province to dismantle their houses and leave the area. The decision was made by Ang Maltey, Provincial Court President to accuse those villagers had illegally lived the other’s land owned by Mr. Touch Phally Sovann. Those who were arrested that Friday included Mang Puthy, 31, branch president of IDEA; Uk Vanna, IDEA’s administrative staff; Sem Thean, local activist; Kung Rithy Poipet commune councilor from SRP; Phean Seng Ly, local journalist; 3 landlords; and some 20 tailors.

Blockage of Anti-Thai Protests Violated Freedom of Expression

On July 15, 2009, a demonstration was planned and led by Rong Chhun, the president of Cambodian Confederation of Unions (CCU) in participation of other 150 members to hold in front of the former National Assembly building to mark the one-year anniversary of Thai troops invading Cambodian territory near Preah Vihear temple.

CCHR Not Allowed to Hold Public Forum over Boeung Kak

In relation to the protests of local villagers against the development project of Shukaku Inc to fulfill land in Beong Kak area, the Cambodian Center for Human Rights (CCHR) had been trying to make arrangements to hold a public forum so that the concerned officials and residents of Boeung Kak Lake in Phnom Penh were able to discuss the eviction issue of these residents related to what local villagers accused of being without appropriate and just compensation, which is stated in the 2001 Land Law of Cambodia. The Municipality of Phnom Penh has leased, allegedly illegally, the natural lake called Boeung Kak and its surroundings to Shukaku Inc., a private development company owned by a Senator from the ruling Cambodian People’s Party (CPP), for a period of 99 years for US$79 million. This municipality has since been pressuring the residents of the area to accept its compensation package, an offer which the residents have repeatedly rejected.

Authorities Banned Meeting of Khmer Krom Ceremony

On 4 June 2009, Khmer Kampuchea Krom Community (KKKC) initiated and led by Mr. Thach Setha, executive director planned to hold the 60th commemorations of the loss of Khmer Kampuchea Krom Territory to Vietnam during the period French protectorate in 1850s. Meanwhile, all participants were also planning to offer food to 1949 Buddhist monks, the mark of the year when French government tore down the Kampuchear Krom land to Vietnam up to present. The venue was first intended to hold at Chaktumuk Conference Hall, located near Plaza Hotel in Chaktomuk commune, Chamkamorn district, Phnom Penh.

Mondulkiri Activists Blocked of their Access to Ethnic Group

On June 16, 2009 some local rights activists were blocked and banned the access to the visit of Phnong ethnic villagers in Pouteut village, Bou Sra commune, Pich Chenda district, Mondulkiri province that were celebrating their traditional ceremony in an attempt to slaughter a buffalo and put curse on a French-Cambodian rubber planation that the villagers claimed had grabbed their forest and shifting land. In addition the group became the subject of charages of incitement for helping those ethnic residents to protest against the company.

Police Suppressed around 3,000 Workers in Dangkor

On 25 June 2009, approximately 3000 garment factory workers held demonstration in order to demand for changing director of a union was suppressed with electronic shock and gun by 100 Chom Chao district police officers at Sky High Garment factory. During the protest, at least 20 people was beaten and hurt. The other 19 had seriously been physically assaulted with their electric buttons before they were arrested and sent to Dangkor police office in order to ask them to stop leading workers to continually protest against the factory.

Mondulkiri Police Banned Rights Group from Meeting with Ethnic Minority

On May 23, 2009 around 10 NGOs were banned by local police in Tangtes commune, Pichreada district, Mondulkiri from doing research and meeting with local villagers in 2 villages, Trangtes and Ratek village of the above area. Those 10 NGOs included ADHOC, CCC, World Vision, DPA, NTLP, YRDP, IACT, CED, CLEC and Sor Sor Troung.

Mu Sochua Barred from IPU Regional Seminar

Repeated things, once again Mrs. Mu Sochua, SRP lawmaker was prevented from attending the “Regional Seminar on the Role of Parliaments in Promoting Peaceful and Sustainable Societies in South East Asia,” at Inter-Continental Hotel on March 9, 2009. The seminar was co-sponsored by the National Assembly, the Senate and the Inter-Parliamentary Union (IPU); and the objective was as well for elected members of parliament from South East Asia to discuss issues that were prevalent in post-war societies and on conflict resolutions and the role of Parliament during and after conflict.

Mu Sochua Barred from Event

On Thursday, February 5, 2009 Mrs. Mu Sochua, SRP lawmaker was banned by some Hun Sen’s bodyguard unit from her way to participate in a government sponsored forum on “How Cambodia will deal with the global economic crisis”.

Hun Sen Warned Sam Rainsy over NEC Fine

The president of SRP Mr. Sam Rainsy was sued by the National Election Committee for his criticizing the Cambodian People Party (CPP) during the national election campaign, July 2008. He was found guilty and demanded to pay 10 million Riels (US$2,500) for compensation because the case was rightfully a criminal matter. The matter had been sent to the Phnom Penh Municipal Court, which asked the National Assembly to revoke Sam Rainsy’s immunity so that the court could implement the case.

SRP Lawmaker (Ho Vann) Summoned for Questioning over Defamation

On 25 May 2009, municipal court Deputy Prosecutor Sok Roeun was invited SRP lawmaker Ho Vann to appear at the court on June 5 for questioning over allegations of “defamation and incitement to case felony-misdemeanor crime successfully and incitement to cause felony-misdemeanor crime successfully and incitement to cause felony-misdemeanor crime unsuccessfully.” This invitation responded to the lawsuit filed by two lawyers, Kheng Ly and Taing Meng Sroy, on behaft of the 22 RCAF officers who received the decrees from the Vietnamese military. The cause of the lawsuit against Ho Vann is his criticism expression toward the 22 RCAF officers who received the decrees from the Vietnamese military.

Kong Sam Onn, Hua Lawyer Faced Bar Inspection

After the press conference on 23 April 2009, Mr. Kong Sam Onn, a lawyer representing MP Mu Sochua in her defamation against Prime Minister Hun Sen could be suspended from his legal professional if the Bar Association of the kingdom of Cambodia will find him guilty on violation of the code of ethics for lawyer.

Defamation Case between Mu Sochua and Hun Sen

Kampot Sam Rainsy Party lawmaker, Mu Sochua said on April 23, 2009 she would file a complaint against Prime Minister Hun Sen, who she accused of defaming her. For this lawsuit, she only asked for 500 riel note from the primer.

Meato Phoum Publisher Sued for Defamation

Mchas Srok Publisher Served about 2 Years for Defaming Sok An

On June 3, 2009 Hong Chakra, Khmer Mchas Srok publisher was summoned by Municipal Prosecutor Sok Roeun to clarify about his articles published 5-7 April 2009, “Hun Sen Broke Bad and Corruptive Ministers around Sok An” and “Pro-Sok An Minister Faced Dismissed from Position”, which published May 2. His articles received lawsuit from the government’s lawyer to accuse him of disinformation.
