Minor Crimes Police Officer Assaulted a Man

A violence case took place at about 7:45 pm on December 13, 2009 by a Minor Crimes Deputy Police Chief Neang Sokna on a victim, Phat Dara, 25. The victim is single, working as a mechanic. The event happened behind Buddha Khosachar, called Dam Dek Pagoda, in Srah Chork, Daun Penh district, Phnom Penh. The perpetrator used his short gun, Revolver to hit him on the face, head and ears, causing the victim bleeding. The victim has four brothers, living in poor condition, in No 28, St 216, Khmuagn commune, Sen Sok district, but nowadays he lives in Heng Heng Garage, No 12, St 39, Srah Chork commune, Daun Penh district, Phnom Penh.

Based on the interview with witnesses, Heng Heng Garage owner, other mechanics and local people around described the event that at about 7:00 pm there were two cars, driving very fast and racing on the street besides the pagoda from the north to south. The front car was Corola, black with plate number 2I 6471, driven by the perpetrator’s partner; and the other behind was Camary, yellow with plate number 2J 6865, driven by Neang Sokna. When they arrived at the corner and turned into street 39, they did not slow down at all. At that time, Phat Dara shouted and warned the children not to play on the street because it may have caused dangerous. Suddenly the front car stopped abruptly. Because it was quick and dead-end road, the car from behind could not manage and then hit and indented the plate and the back part.

When getting off the car, Neang Sokna was screaming as bringing out his gun and asked for who had shouted at him. He looked and sounded drunk. Later the victim walked up to him in order to explain the situation, immediately the police officer used the gun to beat the man on the face, head and both ears bleeding. The perpetrators also kicked him on the chest many times. Even though the villagers; especially the victim’s boss, asked them to stop, they did not listen. They dragged him to beat in the pagoda. At that time, Neang Sokna fired him two shots, but they did not burst out. He was also trying to aim his gun at people around him; that was why no one could take pictures or video the event.

Next, Neang Sokna used his radio phone to call some other men. Not long, several men with three motorbikes arrived. They also started hitting him as well; and then handcuffed and drove the victim to Phnom Penh Minor Crimes Bureau.

According to what the victim told to his mother, when he was brought to the police office, he was twisted on his neck and shocked to lose conscious many times. When the matter probably became known by high ranking officials, Neang Sokna asked his subordinates to send the victim to Calamette Hospital.

On December 16, Dara’s family filed complaits with the Ministry of Interrior and Phnom Penh Municipal Court. Now he has left the hospital with his family to cure by traditional healer because the family does not have enough money to pay for his treatment. However, the victim is still experiencing chest pain and coughing up blood.

It has been seen that the act of the minor crimes deputy police chief is really cruel and inhuman against his duty and responsibility as a police man. His act seriously violates the dignity of human being and right to life. The officer breaks the Universal Declaration on Human Rights, the Covenant against Torture and the International Covenant on Civil and Political Rights, in which Cambodia is also a signatory country of these international instruments.

Therefore, the royal government of Cambodia; especially involved institutions, via the court, has to take immediate action to haul up the criminal.
