Khmer Amatak Publisher Faces Charge of Disinformation and Defamation

On August 3, 2010 Phnom Penh Municipal Court of First Instance was planning to summon Khmer Amatak publisher Bun Tha for questionings in accordance with the complaint by Kao Kimhuon, State of Minister of the Ministry of Foreign Affairs and International Relation and also Director of Cambodia University. The publisher has been sued for disinformation and defamation related to two articles issued since 2009, “Students Pay 20,000 riels for Examination Document”.

Mr. Kao Kimhuon bases on Article 10 of the 1995 Information Law and Article 63 of the Provisional Law of UNTAC to file the complaint against Mr. Bun Tha for the above accusations.

The officials asserted that the articles really affected his reputation and he was trying to conciliate the case by asking Mr. Bun Tha to correct, but he (Mr. Bun Tha) disagreed to do that. Therefore he would let the court to process the case. Kao Kimhuon has Sok Chan as his own lawyer to represent him; whereas Bun Tha has Sam Sokung as his lawyer.

Mr. Bun Tha said that he has got the warrant, which issued on July 7, 2010 by Deputy Municipal Court Prosecutor Meas Chan Piseth and asked him to present at court on August 3. He added he had enough evidence and document to defend him.
